Refund Policy and Right of Withdrawal

Scope
This policy applies to paid digital products and services offered by Arctium ("we", see the Legal Notice), in particular Arctium Pro subscriptions and other digital content or services sold on arctium.io.
The Arctium App itself is free. It is installed through the Microsoft Store; for anything you buy inside the Microsoft Store, Microsoft's terms of sale and refund rules apply.
Who you buy from
Purchases on arctium.io are processed by our payment partner Paddle (Paddle.com Market Ltd. or its affiliates) as the merchant of record. Paddle handles the checkout, payment, invoicing and, where applicable, refunds. The purchase contract is concluded with Paddle, and Paddle shows its own withdrawal instruction at checkout. Paddle's checkout terms apply in addition to this policy. If anything here and Paddle's terms differ, the statutory rights described below remain unaffected. The instruction below describes those rights and applies directly where you buy from Arctium itself.

Right of withdrawal for consumers
If you are a consumer (a natural person buying for purposes that are outside your trade, business or profession), you have the following right of withdrawal (sections 312g and 355 of the German Civil Code, BGB).

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day of the conclusion of the contract.
To exercise your right of withdrawal, you must inform us (Arctium, Am Feldkamp 4, 48488 Emsbüren, Germany, email: legal@arctium.io) of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you requested that the performance of services begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
Early expiry of the right of withdrawal for digital content and digital services
The right of withdrawal expires early for contracts on digital content that is not supplied on a tangible medium (for example a Pro feature that is unlocked immediately) if we have begun performance after you (section 356 (5) BGB)
- expressly agreed that we begin performance before the end of the withdrawal period, and
- confirmed that you know that you lose your right of withdrawal by giving this consent, and
- we have provided you with a confirmation of the contract.
For digital services (for example a subscription that runs for a period of time), the right of withdrawal expires (section 356 (4) BGB) when the service has been fully performed, provided you expressly agreed that we begin before the end of the withdrawal period and confirmed that you know that you lose your right of withdrawal once the service is fully performed. If you withdraw before the service is fully performed, you pay for the part already provided, as described under "Effects of withdrawal".
Because Pro features and subscriptions are made available immediately after purchase, you will be asked for this consent and confirmation at checkout. Without it, access starts after the withdrawal period has ended.

Subscriptions
- A subscription renews automatically for the period you chose (for example monthly or yearly) until you cancel it.
- You can cancel at any time in your account or through the link in your Paddle receipt. The subscription then ends at the end of the period already paid for. You keep access until then.
- There is no pro-rated refund for the remaining part of a period, unless the law says otherwise or we agree to it as a goodwill gesture.
- We announce price changes ahead of time. If you do not agree, you can cancel before the new price takes effect.
Refunds beyond the statutory right
Even where no right of withdrawal exists or it has expired, we want you to be happy with what you bought. Get in touch at legal@arctium.io if
- a Pro feature does not work as described and we cannot fix it within a reasonable time,
- you were charged twice or for something you did not order, or
- something else went wrong that you think we should look at.
We look at every request individually. Goodwill refunds are at our discretion and go back to the original payment method.
Statutory warranty rights
Your statutory rights for defective digital products (sections 327 and following of the German Civil Code, BGB) are not affected by this policy.
